FSA reimbursements of same-sex spouses' expenses
(Feb. 4 2014) The latest IRS guidance confirms that a flexible spending account (FSA) under a cafeteria plan like DU's plan – including a health, dependent care or adoption-assistance FSA – may reimburse qualifying expenses of a participating employee's same-sex spouse. The guidance confirms that, after the Windsor decision on June 26, 2013, same sex couples having a marriage license from a state that recognizes same sex marriage may be reimbursed for applicable FSA expenses incurred after the date of their marriage.
Please contact Total Rewards at email@example.com or 303-871-7420 if you have any questions regarding FSA reimbursement.
